More than 80% of establishments have already adapted to the Tables and Chairs Ordinance (23/03/2017)

The councilman of Economy, Juan Gil, ensures that the local government remains open to dialogue and that if there is a proposal of technicians external to the City that guarantees that it is possible to use other measures, there would be no problem in presenting the proposed modification

The councilman of Economy, Juan Gil, has offered a press conference in which he has clarified the doubts that have been generated and the position of the City of Jumilla before the statement issued by the Association of Hosteleros on the Ordinance of Occupation of the Way Public with Tables and Chairs.

Juan Gil has stated that "from the local government we understand that it is not necessary to modify the ordinance, since the aspects that, according to the Association of Hosteleros, present problems can be remedied. First and as for the distance between bollards Is submitted by presenting a certificate signed by a competent technician to guarantee the security measures of the fencing, when the distance between pylons exceeds 1.5 meters. On the other hand, as for the height of the awnings not anchored to the pavement, this will depend In each specific case of its situation with respect to the local ".

The mayor of the area has reported that "as of today most establishments, more than 80%, comply with regulations, have their businesses in order and can exercise the activity on an equal basis for all."

He also said that in this legislature has not yet sanctioned any innkeeper for these matters, offering the time needed to adapt to an ordinance that came into force in 2013. "What is clear is that they have to adapt Because otherwise would be unfair to those who have done the remodeling, "he says.

However, Gil Mira said that "the local government remains open to dialogue and that if there is a proposal of technicians external to the City that guarantees that it is possible to use other measures there would be no problem in presenting the proposal to amend the ordinance, something that You know from the Association of Hosteleros. But while it is not so our duty is to ensure the safety and interests of all Jumillans.

Evolution of the ordinance

The ordinance was put into effect in January 2013, which already specified the distance of 1.50 meters between pillars of the fences, without any verbal or written statement of not agreeing on the part of the association.

In March of 2015 a modification was approved that included the height of awnings and marquees between 3.20 and 4 meters, by technical prescription to comply with the regulations of the General Plan of Ordination of Jumilla and to avoid that the tents rise above the first floor household.

In June 2016 the Association of Hosteleros presents a draft that is studied by municipal technicians and which contemplated modifications "that would have been a big problem for hoteliers, such as re-dismantling the terraces every night, being ours a lot More flexible, being the modification of the measures the only intention of modification, "says Juan Gil.

"In a meeting the technical report on the proposal is transferred to us, to our surprise they show us the total ignorance of the same by all of them, except the two representatives of the association that were who presented it, clarifying that neither person has Activity in this sector ".

On September 13, 2016, IU-LV presents a modification letter, which proposes to modify the measures.

The commission and the corresponding technical report are taken, all political groups consider that the modification is not possible, because it is not in accordance with law.

About the release

Regarding the affirmations made in the communiqué of the Association of Hosteleros, the councilman of Economy has indicated that "the ordinance has not modified in any sense of tort and is the same as in the previous legislature."

On the other hand, he emphasized that "technicians are to comply with security measures, with the same standards for all." All applications are treated in the same way and what varies is the uniqueness of the premises. They came in contact to use this same ordinance. "

Finally, he added that "the communique says that the collective feels persecuted, which is uncertain when they themselves were the ones who presented at the time the proposal that was collected in the ordinance."
